Terms of Service

1. Scope

These Terms of Service ("Terms") govern the contractual relationship between Capra GmbH, operating under the brand TrailCamHub (hereinafter referred to as the "Provider"), and users of the TrailCamHub platform (hereinafter referred to as the "User").

By creating an account or using the platform, the User agrees to these Terms.


2. Subject of the Agreement

TrailCamHub is a web-based platform that enables Users to upload, organize, manage, analyze, and share trail camera photos, videos, and related data.

Access to certain features may be provided through subscription plans, trial periods, or free tiers, as described on the website.

The Provider may continuously improve, modify, add, or remove features, provided the essential functionality of the service is not materially impaired.


3. Conclusion of Contract

The presentation of services on the website does not constitute a legally binding offer.

The contract is concluded when:

  • the User creates an account and accepts these Terms; and
  • where applicable, the Provider confirms a paid subscription or purchase.

The Provider may refuse registrations where legally required or where misuse is suspected.


4. Account Registration and Security

Users must provide accurate and complete information during registration.

Users are responsible for:

  • maintaining the confidentiality of their login credentials;
  • preventing unauthorized access to their account;
  • all activities conducted through their account.

The Provider must be notified immediately if unauthorized access or security breaches are suspected.

Accounts are personal and may not be shared unless explicitly permitted by the Provider.


5. User Content and Ownership

Ownership

Users retain all ownership rights to photos, videos, metadata, and other content uploaded to TrailCamHub.

Nothing in these Terms transfers ownership of User Content to the Provider.

License to Operate the Service

By uploading content, the User grants the Provider a non-exclusive, worldwide, royalty-free license to:

  • store;
  • host;
  • process;
  • display;
  • transmit;
  • create technical copies of;

such content solely as necessary to operate, maintain, secure, and provide the TrailCamHub service.

This license automatically ends when the content is deleted from the platform, subject to backup retention periods and legal obligations.

No Commercial Use Without Consent

The Provider will not sell, license, publish, distribute, or otherwise commercially exploit User Content without the User's explicit consent.


6. Sharing and Access Permissions

TrailCamHub allows Users to share content with selected individuals.

Users have full control over:

  • who receives invitations;
  • who may access shared content;
  • permission levels granted to invited users.

Available permission levels may include:

  • view-only access;
  • download permissions;
  • commenting permissions;
  • editing permissions;
  • management permissions.

Only individuals explicitly invited by the User may access private shared content.

The User is solely responsible for selecting recipients and assigning permissions.

The Provider provides the technical means for sharing but cannot control actions taken by invited recipients after access has been granted.


7. Public Galleries and Public Sharing

All content uploaded to TrailCamHub is private by default.

Photos, videos, metadata, and other content will only be made publicly accessible if the User explicitly chooses to publish such content.

The Provider will never make User Content publicly visible without the User's explicit action or consent.

Users may revoke public sharing at any time, subject to technical limitations and caching periods.


8. User Responsibilities

Users are solely responsible for all content uploaded, shared, or published through the platform.

Users warrant that:

  • they possess all necessary rights to uploaded content;
  • uploaded content does not infringe copyrights, trademarks, privacy rights, personality rights, or other third-party rights;
  • uploaded content complies with applicable laws.

Users are responsible for obtaining any required permissions from individuals appearing in uploaded content where required by law.


9. Prohibited Conduct

Users may not:

  • upload illegal content;
  • infringe intellectual property rights;
  • upload malware, viruses, or malicious software;
  • attempt unauthorized access to systems or accounts;
  • interfere with platform operation;
  • use the platform for unlawful purposes;
  • upload content that violates privacy rights of third parties;
  • scrape, reverse engineer, or attempt to extract proprietary platform functionality.

The Provider may remove content or suspend accounts that violate these Terms.


10. Trial Period and Free Accounts

The Provider may offer free accounts, trial periods, or promotional access.

Available features, storage limits, upload limits, sharing capabilities, and other functionality during such periods may be limited.

The Provider may modify or discontinue trial offerings at any time.


11. Prices and Payment Terms

Current subscription prices are displayed on the website.

Unless otherwise stated, all prices include applicable VAT.

Subscription fees are payable in advance for the selected billing period.

Payments may be processed through third-party payment providers.

The User authorizes recurring billing where applicable until cancellation.

Credits and Photo Processing

Certain features are paid for using credits. Processing one photo costs one (1) credit.

The processing of a photo includes the available automated AI detection for that photo — in particular the number of animals detected, species identification, and, where this is sensible for the species, an indication of whether antlers are present. These detection steps are included in the single credit charged per processed photo; no additional credit is charged for them.

Credits are purchased in packs as displayed on the website and can be used solely within the platform. The accuracy of AI detection is governed by Section 16.

Credits are non-transferable and are not refundable, except where mandatory law provides otherwise (see Section 13) or as expressly provided in Section 20.


12. Subscription Term and Cancellation

Subscriptions run for the billing period selected by the User.

Unless otherwise specified, subscriptions automatically renew for successive billing periods.

Users may cancel subscriptions at any time through the platform or in text form.

Cancellation becomes effective at the end of the current billing period unless otherwise stated.

No refunds are provided for partially used subscription periods unless required by law.


13. Right of Withdrawal

Consumers within the meaning of Section 13 German Civil Code (BGB) may have a statutory right of withdrawal.

Details are provided separately in the Revocation Policy.

Where the User expressly requests immediate access to digital services, the right of withdrawal may expire in accordance with applicable law.


14. Availability of Service

The Provider strives to maintain high platform availability.

However, uninterrupted availability cannot be guaranteed.

Access may be temporarily restricted due to:

  • maintenance;
  • security measures;
  • technical failures;
  • force majeure events;
  • third-party service outages.

The Provider shall not be liable for temporary service interruptions beyond its reasonable control.


15. Data Backup and Content Preservation

The Provider employs commercially reasonable security and backup measures.

However, the Provider does not guarantee permanent preservation of uploaded content.

Users remain responsible for maintaining their own backups of important photos, videos, and data.

To the maximum extent permitted by law, the Provider shall not be liable for loss of User Content.

Storage Limits

The Manager subscription includes storage for up to one thousand (1,000) photos and one hundred (100) videos per account. Items placed in the "Deleted" area do not count toward these storage limits.

When a storage limit is reached, the Provider may automatically and permanently remove items from the "Deleted" area in order to free up storage, without separate prior notice.

Users remain responsible for maintaining their own backups of important content. The Provider will make the applicable storage limits transparent within the service.


16. Artificial Intelligence and Automated Processing

Certain platform features may use automated systems, including artificial intelligence technologies, to process uploaded content.

Examples may include:

  • image classification;
  • species recognition;
  • object detection;
  • metadata extraction;
  • content organization.

Such processing is performed solely for providing and improving platform functionality.

The Provider does not claim ownership of content processed by such systems.

No Warranty of Detection Accuracy

The Provider does not warrant the accuracy, completeness, or reliability of AI-based detection results, including animal counts, species identification, or antler or sex indications.

Such results are generated by automated systems, may be incorrect or incomplete, and are provided "as is." Users must not rely on these results for decisions of legal, regulatory, financial, or safety relevance and should verify them independently.

This Section does not exclude or limit liability where Section 17 (Liability) or mandatory law provides otherwise.

Persons and Vehicles in Images

Where images are detected as containing identifiable persons or vehicles, the Provider may automatically blur, mask, restrict, or hide such images or parts thereof — in particular in shared or publicly accessible contexts — in order to protect the privacy rights of third parties and to comply with applicable law.

Such measures affect the display of content and do not delete the User's original files, except where removal is required by law.

The Provider is not obliged to perform such measures and does not guarantee that all persons or vehicles are detected or obscured.


17. Liability

The Provider is liable without limitation for damages resulting from:

  • intent;
  • gross negligence;
  • injury to life, body, or health;
  • mandatory statutory liability.

In cases of simple negligence, liability is limited to breaches of essential contractual obligations and foreseeable damages typical for the contract.

The Provider shall not be liable for:

  • indirect damages;
  • loss of profits;
  • loss of business opportunities;
  • loss of User Content;
  • actions of invited third parties who received access through permissions granted by the User;

except where mandatory law provides otherwise.


18. Intellectual Property

All software, source code, databases, designs, trademarks, logos, and other platform components remain the property of the Provider or its licensors.

Users may not:

  • copy;
  • reproduce;
  • distribute;
  • reverse engineer;
  • commercially exploit;

any part of the platform without prior written permission.


19. Privacy and Data Protection

Personal data is processed in accordance with the TrailCamHub Privacy Policy.

By creating an account and using the platform, Users acknowledge the processing activities described therein.

Use of authenticated platform areas may require cookies, authentication technologies, and other technical mechanisms necessary for operation of the service.


20. Suspension and Termination

The Provider may suspend or terminate accounts if:

  • these Terms are violated;
  • payment obligations remain outstanding;
  • abuse or fraud is detected;
  • platform security is threatened;
  • operation of the service would otherwise be jeopardized.

Where reasonable, the User will be notified before permanent termination.

The Provider may remove unlawful content immediately.

Exclusion of Users and Refund of Credits

The Provider may exclude, block, suspend, or terminate a User's access at any time, in particular in the event of misuse of the service, violation of these Terms, or unlawful conduct.

Where the Provider blocks or terminates a User's access under this Section, it will refund the monetary value of the User's remaining unused credits, unless mandatory law provides otherwise. Refund of unused credits does not affect the Provider's right to claim damages caused by the User's conduct.


21. Changes to These Terms

The Provider may update these Terms where necessary to reflect:

  • legal requirements;
  • technical developments;
  • new platform features;
  • business changes.

Users will be informed of material changes through appropriate means.

Continued use of the platform after such changes become effective constitutes acceptance of the revised Terms.


22. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

Mandatory consumer protection provisions of the country in which the consumer has their habitual residence remain unaffected.

For merchants, legal entities under public law, or users without a general place of jurisdiction in Germany, the exclusive place of jurisdiction shall be the Provider's registered office.


23. Severability Clause

If any provision of these Terms is invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

The invalid provision shall be replaced by a valid provision that most closely reflects the economic purpose of the original provision.
